It is a crime scene until it is determined to be otherwise.

Both of these facts must be established.

I'm not sure of your point, however. Is someone denying it became a crime scene once she posed a threat to the cops?
And the agents in question fled before that was done. ICE has a habit of tampering with crime scenes and evidence. Like when they moved the car that other woman was shot in to another state. Not to mention, ICE has had cases thrown out when the judge realized they were lying in court.

You have to keep in mind that the decedent was the criminal.

Unlike Minnesota's hit-and-run statutes (which apply to drivers in accidents), there's no equivalent federal or state criminal statute mandating federal officers remain at a scene they created via use of force. Supremacy Clause protections generally shield federal agents acting in official duties from state prosecution unless actions are deemed unreasonable or outside scope.

So, technically, there was no duty for the shooter to remain at the crime scene as he was not a criminal.

Of course, Minnesota will try to make him the criminal, and they may end up locking him up for 20 years like they did the other guy was falsely convicted in the death of George Floyd.
