No Recognized Loss Unless Defects Are Cured

Your Claim does not calculate to a Recognized Loss due to certain defects listed in the letter and therefore is not eligible to receive a distribution from the Net Settlement Fund. Please be aware that Recognized Loss is not the same as market loss. If you experienced a market loss, it does not necessarily mean that you have a Recognized Loss. It is possible to have experienced a market loss and still have no Recognized Loss under the Plan of Allocation. In addition, if you had an overall market gain from your eligible transactions, your Recognized Loss is automatically $0.00.



You can resolve this deficiency by resolving the other deficiencies that are listed in the letter you received. If you fix those other deficiencies, it is possible that this deficiency will become resolved too. As another option, if you have any other eligible transactions that you did not include on your Claim Form, you can submit those additional transactions to us now, and we will process them and recalculate your Recognized Loss. If you submit additional transactions, you must also submit a copy of supporting documentation.
