The Sec. Exchange act of 1934 granted the power to regulate credit in the purchase of securities to the FEDERAL RESERVE BOARD The SEC is charged with the responibility of enforcing the rules that the FRB establishes.

FRB established Reg. T, which governs the extension of credit by broker-dealers; Reg U governs the extension of credit by banks, and reg G govern the extension of credit by lenders other than broker-dealers.

Over the counter securities may not be purchased on margin unless the security is specifically designated as elligable by the FRB. The FRB will examine the national interest in the stock, the depth and breadth of the market, and I think suitability of info regarding the issuer.The FRB will not allow listing on the OTC marginable list unless the stock has 4 bonafide MM A stock listed on the national market system is AUTOMATICALLY marginable
