Although the Justice Department could tackle Windows 98
under the case it filed against Microsoft over the consent
decree, it is more likely that the new case would be brought
under the Sherman Act, lawyers familiar with the
investigation said.

Some in the department favor such a case because it could
cover Microsoft's activities relating to Windows NT and CE
.
But such an approach could be tricky, some legal experts say,
because the government would have to prove that Microsoft
has a monopoly with Windows in the personal computer
market, a point company executives have repeatedly refused
to concede.

I can live with that DOJ's investigation on Windows95 and Windows98,
but I cannot agree that Windows NT and Windows CE should be
investigated at this moment.
Windows NT and Windows CE do not have dominant market power yet. How can Sherman Act be applied to them?
