With all due respect there is a significant difference between laying low pursuant to establishing/maintaining competitive strategies/advantages and a basic fiduciary responsibility to cummunicate with one's shareholders regarding issues which are already public.

The shareholders are not concerned with TMSRs superior fundamentals. These are 'sunk costs'. The shareholders are concerned about 1) TMSRs [perceived?]: failed secondary offering, and 2) accordant? inability to gain confidence with the street [incl. have their market makers, at least, support their BUY rec's at the price the day they issue said BUY REC], and 3) attract institutional ownership specifically pursuant to said superior fundamentals, and 4) their website status, and 5) substantial shareholder value destruction since October...and 6) when this is coupled with a management which plays the 'silent' card yet one which is also [contemporaneously] capable of repricing insider options without shareholder approval ref/'95-'96 Proxy...shareholder concerns would seem to be appropriate, at the least...concerns, not litigation...yet management apparently is simply not willing to acknowledge said concerns...(of which can, will, encouraged to be negotiated by Proxy in the absence of management/Board accountability to one's shareholders)...and, again, their silence merely serves to exacerbate said concerns...

... we wouldn't call that a competitive advantage.
