Actually, it's the same class action suit, just another law firm (#8 I believe).

IOM has not given guidance and warnings in the past - (a much discussed issue) and there is no reason to expect they will start now. Therefore a lack of warning should not necessarily be interpreted to mean that they will meet estimates.
