Links/Queasiness
Alan: Thank you for taking the time to post the links. I was familiar with those documents prior to my post, so clearly my "queasiness" was not dispelled by them. For the most part, I would prefer to take some time to refresh my memory of them before offering any specific comments I might deem warranted. If I have the opportunity, I will attempt to do this later today.
The exception to the foregoing is the commentary by Mr. Ebersohl which I have seen circulated rather recently from two sources with minor variations. As I recall, one of the circulated documents contained the notation that this was a legal analysis from Mr. Ebersohl, a licensed attorney and included a comment above his closing signature to the effect of 'PDG, say goodbye to Venezuela'.
To be quite blunt, and bearing in mind that Crystallex has in no way endorsed these claims, commentaries such as Mr. Ebersohl's do little to advance the public credibility accorded the company or its case. I find it difficult to take seriously any 'analysis', legal or otherwise, that is punctuated with multiple question and exclamation marks and contains unsubstantiated third party claims with respect to potential reserves. (Judging by the quality of your own posts, I would not be surprised to learn that you have some similar reservations.) If, in fact, Mr. Ebersohl is an attorney, I would not want him representing my interests in a dispute over a parking violation. My opinion in this regard would not change if the CSJ convened this afternoon and delivered a favourable ruling for Crystallex.
The other documents to which you refer carry much more weight and deserve more consideration.
I will close now by noting that I am familiar with much of the information that has been compiled by members of the Stockhouse Forum. The documentation is impressive and probably without equal in the short history of stock fora on the internet. However, as I believe W. v O. Quine argued in his classic "From a Logical Point of View", there are no brute facts prior to interpretation. Although Quine was discussing science, particularly physics, I think this is equally true of law. It is precisely the interpretation of some of the documentation assembled that gives me pause.
