You may be fooled by the name of patents category. Yes, methodology can be patented. I'll give you an example. Most chips made today are made of Al deposite on Si wafer. And I bet you've heard IBM was recently rewarded patents to deposite Cu. Please note that the IBM patents cover methodology but do not give exclusive right for IBM to use Cu. If you're smart enough, you may think of a more efficient way to deposite Cu or gold, silver, whatever... What I mentioned above is an example of methodology patents. However, Dell can't claim a patent on BTO/JIT. To my best understanding, the local grill takes my order before char-boiling my hamburger. However, McDonald's next door makes 20 hamburgers every 15 minutes so that I can pick up one immediately after the order. Do you think the local grill can file for a patent so that McDonald's must pay royalty before emulating this "methodology?"
