Do you honestly believe Essary would have admitted it (to you especially)** if he had received a subpoena or had even been questioned? Remember this is an individual who had denied authoring the press release revealing Mohamed's youthful discretions.
I am not waivering in my position about positively knowing that Gayle Essary wrote the press release. He did not act as a consultant, but rather as the author. I have seen the document and have made certain that it was placed in Document Trust by both the State of Tennesse and the SEC.
Gayle Essary has threatened to sue me because of this and similar statements. I can assure you that I am not seeking a lawsuit or confrontation with him. I am merely certain of what I witnessed and saw. I did not see Essary prepare the fax, but it did come from his number and had a cover sheet saying it was from him. He even phoned to make sure it came in and I answered the phone to confim its receipt.
The bottom line is because of the fax and other incidents I witnessed, I firmly believe that Gayle Essary was a key player in the GIFS scam. This is an informed opinion. The fact that a fax came from his office and he authored it is a fact. Michael Rehtorik could and should confirm this, I believe, as he was the individual to whom the fax was addressed. Should Rehtorik say Essary did not write the press release, then it would fall on Rehtorik to be the author; Rehtorik, as Director of Investor Relations normally prepared/authored the press releases.

**BTW, if Essary should ever contact you, perhaps he could explain why thousands of shares of GIFS stock were transferred--regularly--to Douglas Furth. Were these transfers to the IRI or to Mr. Furth. They were transferred to an account bearing Mr. Furth's name. |
