Matty,

While the SEC may or may not have jurisdiction over individual investors and their claims, they certainly are not prevented from including said individuals in their investigations.

Also, shareholders of said company would be able to seek recourse from said individual who claimed to have information directly from the company. They may or may not be successful, but it doesn't cost much to file a civil suit, even in NYC.
