I don't have the patent in front of me, so I'll assume it does expire in 2002. Damages are not collectible on sales made after the patent expires. The point is, GIFT is entitled to royalties for sales made during the life of the patent. Delay by the courts doesn't shorten or lengthen the time during which a royalty is due. Delay by the court merely changes the date on which the patentee ultimately sees a check.
