This safe harbor clause came about to prevent companies from being sued by their shareholders if the projections did not materialize.
All US companies are covered by this whether or not it is explicitly stated. I believe there had been some frivolous lawsuits in California before the Securities Litigation Reform Act of 1995.
Many companies post it. Do a search on "safe harbor" and you will find lots of companies using it.
