Thanks White Shoes,
Here is how smkcpa@aol is trying to defend himself on yahoo: "What has my registering a domain name in the hopes of leasing out the rights to it at a later date have to do with stock manipulation and internet fraud?" I'm no expert, but it seems that enough is here for small-time Wall St. lawyers to poke around for more fraud/manipulation evidence. If he does have any ties to MD/ZITL/KEANE, he's in big trouble. Certainly his actions will be cited in future lawsuits, perhaps even by the MD/ZITL defense: "NO, we never illegally hyped our company, it's all the internet lies we had no control over--(and chose not to disavow, for fear of impinging upon 'free speech')!" Regarding the SEC, I have no idea if they would be interested in this or not.
Also, I think he's claiming he never e-mailed or posted anonymously regarding the site. Perhaps, but hard to believe, with how easy it is to be anonymous on yahoo--and with anonymous posts doing just that.
Anyways, thanks again, Greg |
