I'm not a lawyer so I can't comment on their strategy. This lawsuit is just another nail in the coffin. If I was competing against fastcomm for orders I would be handing out their 10 Q and highlighting this part of it .

"The Company does not currently have the resources to pay this judgment in full and continue normal business operations. The Company is currently considering all available options. These options include, but are not limited to, a non cash settlement with the
plaintiff, additional financing, which could involve the sale of all or part of the Company, or reorganization under Chapter 11 of the Federal Bankruptcy Act"

If I saw that I wouldn't buy their product until this issue was settled.
