In a plural sense, "communication companies" as generally outlined "have had" (past tense), to choose one of these routes.
I liken the Telco's vs ISP's to the cable industry in residential service. You can either get basic cable, or the unbundled-products. So with ISP's, they as "enhanced service providers cannot get the added features of Telco's. Thats why the telephony voicemail, call-back, findme/followme and the rest is so important with the "Tempest". As an "enhanced service provider" you don't get what Telco's get.
So when you ask: Is it the infrastructure of the local lines and hardware that will determine that? as in CLEC vs ISP? Its the fee's paid by Telco's that must be paid by all CLEC's. Local & LD included.
I liken it to the fee's payed by each state for highway taxes. In order to get the most from the Governmnet services, you must pay that tax or risk losing additional monies. So its a never ending battle for the ISP's to keep as much as possible like the LADS that allow the use of cable.
Allowing ISP's to have acess to the same collation and unbundled copper provisons as CLEC's would insure the competitive enviroment we need. That's why US West are such thugs....they have now closed off more then 7 states with ISP's not allowed to use the LADS.
Speaking of competitive playing fields for all, it doesn't matter who we are speaking of RBOC's ILEC's. The future for ISP's beside Frame-relay is the xDSL which if you remember, the gentelman Frank C. commented heavily on this subject. Again explaining LADS and its importance:
LADS is a metallic point-to-point, unloaded circuit 2 or 4 wire circuit. A customer of the telephone company who rders LADS service is simply ordering a copper pair between two points, and is not ordering a dial tone or any other telco service with the copper. The customer jplaces its own modems at both ends of the line. The result can be a T-1 speed at a monthly cost that is far less then the cost of a T-1 line from the Telco's/
RB has stated that cable is going to be really hot in the coming years, and the Telco's know it. Thats why companies like US West, Intel, Microsoft, Compaq, have joinded forces to push xDSL as an access technology. Between the three of them, they do have the smoke~ to do the volume and make xDSL modems cost about the same as any other modem.
Telco's cut off ISP's from LADS Tariffs? Telco's gather steam with US West, MSFT, Compq, Intel in monopolizing xDSL while leaving the ISP's out?
This will basicaly steal & strangle the ISP's from the dialup access market. US West has already shut off Idaho, Montana, Nebrasks, New Mexico, North Dakota, South Dakota, and possibly 7 more if they have their way.
I am guessing that with a Franklin Network, you won't need to be ILEC or CLEC, because of the "Tempest" gateway. Its full-feature, just like the Telco's will allow companies like Franklin to remain "enhanced service providers" thus saving mega bucks on tax's.
You have to watch these telco's, US West filed this 14 state LADS shutdown in March of 97.
Tell me why MCI was also backing the ISP's in getting this thing stopped in a few states? RBOC's are THUGS among the tall timbers.

Can you imagine getting xDSL service for as low as $40.00 a month? Its getting that low and lower for the next few years. It will be the savior and the 56k modems will be left in the dust. The USRX 56 is kicking Rockwells in the BUTT!!!, and that 3COM-USRX V.90 is sure looking great.
