Yep, I read your response, but also there were those on the Yahoo board who questioned the $1.40, not being able to find it in the SEC document. There are also alot of winers over there. If those guys really own stock why would they want to talk it down?
In any case Faibish responded to my inquiry as follows:

I don't really know if this will protect us. So what if they have to file s-3? The stock will still drop. I leave the question up to others on the thread to answer. Certainly I don't think I will buy anymore shares until I know more.
