FTC has no problem with Visx collecting procedure fees on its machines (FTC told Visx it's okay many months ago), and since the vast majority of Visx's procedure fees presently DO NOT go thru PPP, there's no real threat to Visx's future earnings.

If FTC has a problem with a few patents, why hasn't the Patent and Trademark Office which issued them said anything about them for the past 6-8 years? Obviously there's really no problem there either.

The only problem is with PPP, which is being dissolved anyway, since it costs more than its worth.

Therefore, the FTC is merely going thru the motions of looking tough at the behest of a handful of disgruntled, greedy doctors and late-comer laser manufacturer(s).

No big deal. This kind of lawsuit has been around for years, and it seems more than coincidental that FTC did this after Visx sued for dissolution of PPP.
