Only too happy to oblige. As they say where I grew up, "you don't know me from a load of coal." You obviously have a critical eye, but don't let it focus too hard on me. It's like juggling. Your hands know what to do if you keep your eyes focused on the apex of the juggling circle. If you watch one ball too closely, your hands forget what to do and you start dropping balls. Here, the apex is the merit of the coal deal, right?
On October 9, I spoke to Bruss on the phone. He told me that the coal deal was "done" and that the final contract would be signed on October 23. The deal would be preceded by promotional efforts. On the next day, a colleague of mine called Levine to confirm. Levine indicated that he could sign a deal the next day, but he wanted to have his lawyer and accountant look the deal over. He had given the interested party until the end of December to do the deal. Seems reasonable, but we couldn't confirm Bruss' statement of October 23. I called Bruss again. He said he didn't know why Levine would be saying that because he knew less about the deal than Bruss, and the deal was "done", reiterating that 10/23 was the date for a final deal. I have email to that effect, if you're interested.
Then I saw Alex's summary of his conversation with Levine on 10/16. I got it through the Stockman forum and found this thread. I emailed Alex's summary to Bruss for his comments. I sent it three times on 10/19, but Bruss' mailbox was full. Finally, I called him on Saturday morning, left a voice mail message that I couldn't get through email and I had something I wanted him to see, the email finally went through and here is what I got back.

Gerry is certainly not hedging his position on the coal deal. I am talking to him as I write. He is meeting with the buying party to finalize the formal letter of intent on Wednsday of this coming week. As far as Tom Kostech is concerned, I talk to him often and he is definately working on CEC. I will be meeting with Tom next week to finalize a deal. I hope that helps Jeff,

I was disappointed to now hear that it was only a letter of intent, but I then posted my first contribution to this thread which raises your question.
With the failed promises from Bruss, I asked whether anyone knew whether Bruss was still working on the stock. Just fishing for information, I guess. Doubt, suspicion, hope, greed, fear..... At the time I posted the first note I was a little uncomfortable revealing my sources of information.
