Glad You got to me, Jimpit, I've not been even tuning in, and I was handed your message. OK - All - Here's a somewhat editorialized version. Not to say that you won't get it all, but just for now, a little digested and names not used.
The opposition have been spending money on their attorneys as though there's no tomorrow. If it keeps up, then they'll end up spending on the disruption and removal of your assets what they might have in a fair sale. But if I say much more along those lines, why, they'd probably get their noses out of joint, and from what I've learned to date, that's easy to accomplish.
Your Committee has found an investor with the right amount of cash, but the Due Dilligence for the kind of investment that we are talking (LESS than 45%)isn't overnight, and the information in a timely fashion isn't easy to get.
Please keep in mind that although we're into the fourth week since the ceiling collapsed, organizing, getting the bankruptcy data and legal advise, not to speak of the endless telephoning, faxing scribbling makes a successful (IF there is one) venture in this time - record breaking. But please note - IF - 'eon' for those of you who remember your ancient Greek.
There have been legal stumbling blocks, doubtfully accurate figures, and questionably motivated players. Believe me when I tell you that you'll see it all, when it's possible to lay the facts bare and not get sued by some doubtfully honest players. No - no point in speculating who they are - - they know, and so will you, when it's time.
I will say this to you, however, for anyone wishing to consult his law text books. What do you call a carefully planned cash shortage, and then an equally planned availablity from a source that bludgeons the opposition into an untenable position, demanding, in effect, a hari kiri response?
The story is a great deal more complex, and ugly. There are major industry players looking at this situation right now! I've spoken to two CEOs so far, and a third is allegedly making some significant judgements tonight and tomorrow.
It's been a damnably long road, and a lot of work, which I frankly don't mean to suggest that I regret. Not a jot. And there WILL be some surprises in the not too distant future, or I'm more gullible than I hope. Whether you - we - get our company back is hanging in the balance over the next 36 hours. Whether that is the last stroke of the pen - - hell no. The story's but just begun...... |
