Gary, This is my GUESS: You are not talking a wealthy individual who has chosen any place to hang her hat as she pleases. (Which is what we are talking about here).

By the fact that you have a lawyer involved, it seems this is NOT a person of wealth and full faculties who is making her own decisions.

I seems you might be talking about someone incapable of make her own decisions AND/OR someone who is NOT wealthy beyond her current needs. OR someone who entered into a long-term situation willingly who gave a large portion (if not all) of her wealth in fair exchange for life-time care.

If my GUESSES are correct, I have no quarrel with you. It's just that is not what we are talking about here. HERE we are talking about PRE-planning. A wealthy individual with the freedom to choose, LONG BEFORE going into Title XIX.
