Dwight, Prior to the TI purchase of Amati, Amati said it would pursue patent infringements of DMT, though they could not pursue until the technology was used in modems that were sold commercially. There were many manufactures who had modems in trials around the world. Trials do not count. Now that TI owns the Patent rights to DMT, and knowing TI's past record on pursuing patent infringements I would say yes, TI will go after Orckit. Amati had licensed DMT to many large companies ie. MOT, TI, NEC, Analog Devices, PAIR, etc. If the Patents were not enforceable, I doubt if companies such as these would have paid the 3%-7% royalties.
