The Markman Hearing is a trial w/o a jury on the issue as whether or not each defendant infringed on any of the claims of the patent as proven in court. The court in such a case can decide not to enforce any of the claims due to precedent or other legal reasons and a defendant may be found, as a matter of law, not to have infringed on the particular claim (but be found to be infringing on other claims).

How this all "plays out", by the Court's decision, will define the scope of the patent (what it covers and what it does not).

I expect the decision to find MORE than enough claims to be valid and that the defendants have infringed to make this a VERY VALUABLE patent. I do not expect a 100% victory. The "right" 20% will make me very happy, wealthy and wise ! --- You and your friends, too. Mel
