Alex...
>>Datek messes up from time to time, but I doubt that other brokers don't. And it looks to me, from frequency and wording of complaints, that datek cleaned up their "treatment of disputes" since about 5 month ago, when they had peak number of complaints
I am preparing to file a dispute myself...
Datek gave me the worst execution EVER on Friday...
was trading BLDPF during it's move in the PM... put in a market order to sell while stock was trading 121 1/4 x 7/16 @ 15:21:23, about 1 minute or so later, I did not have an execution, and the stock was showing weakness... I attempted to cancel my order, and the status of this cancellation went into "never-never land!
I FINALLY called them at about 15:23, and they told me to NOW check the status (how fortunate), and they had just executed me @ 118 5/8!
As you know, Datek says how they can execute marketable orders in 1 minute ot less... BULLS#@T! One minute after their confirmation of receiving my order, stock was trading 121 1/16 x 3/16... They executed me 2 1/2 minutes LATER than their 1-minute statement of capabilities!
I protested via telephone, no return call. I called again, was told to protest via trades@datek.com. I rec'd a (unsigned) response, saying effectively, "tough luck, bub!" I called YET AGAIN, spoke w/a supervisor, who said he'd look into it again.
At this point, I am furious, and am prepared to file w/NASD!!!
