Whoever told you that was confused. Dell is our sole supplier and I can tell you they do not charge sales tax in California. We must accrue use tax for those purchases.

The second individual said something that makes sense, as vendors will only collect taxes in states where they have a presence. Presence is defined as licensed by the state to charge and remit sales tax. Generally the state can only require this if the vendor is deemed to have a presence in the state.

You'd think sales and use tax is a straight forward subject, but nothing could be further from the truth. The next major tax holy war is going to be taxes on internet transactions. The battle is over how you define a "presence" in a state.
