A Markman hearing does not address the validity of patent claims, whether the defendant has infringed, or whether the defendant has any defenses to infringement (e.g. inequitable conduct, license). All the judge does at a Markman hearing is construe the scope of the claims as a matter of law and it is for the jury to decide whether defendant infringed either directly or under the doctrine of equivalents.
