Dan, regarding Lessig:

I don't know about the entire special master debate, but about Lessig personally: Why does HE have to be the special master? There is legitimate concern about his impartiality from Microsoft. Is he the ONLY guy in America who can do that job?

I just don't get why the judge doesn't just find another special master which would eliminate one avenue for appeal. As it stands now, not only is Microsoft appealing the use of a special master, but of all special master candidates, they especially have a problem with Lessig.
