He may be within his rights, I don't know. But in terms of good faith and such (which I never believed in before, but it seems that that is also an issue in legality), he could have just heeded Microsoft's legitimate objections and found someone else.

In selecting Jury, the lawyers are allowed to throw out candidates for no reason. I would think that that principle be remotely applied to this instance where there is a serious question of Lessig being biased. Thing is, why not get a guy who is "cleaner"?

I don't mean to imply that Lessig is a biased liar or anything (before Dan jumps on me). All I'm saying is that there is at least some doubt about him, and in my idealistic world that would be enough to throw him off the case.
