Fischer Imaging Announces Receipt of a New Patent and Filing of Patent Suit Against Trex Medical Corporation
DENVER, April 13 /PRNewswire/ -- Fischer Imaging Corporation (Nasdaq: FIMG - news) announced today that it has filed a second patent suit against Trex Medical [AMEX:TXM - news] Corporation in U.S. District Court for the District of Colorado. The new suit alleges that Trex Medical's StereoGuide DSM stereotactic breast biopsy system infringes U.S. Patent No. 5,735,264, a patent issued to Fischer on April 7, 1998. In its new suit, Fischer seeks damages as well as an injunction to halt any further sales of Trex Medical's StereoGuide DSM.
The StereoGuide DSM system is not only distributed by Trex Medical (formerly Lorad) but also by U.S. Surgical under the tradename ABBI. U.S. Surgical principally distributes the Trex products to the surgical market.
In its previous patent suit against Trex Medical, filed in April, 1992, Fischer alleges infringement on Patent No. 5,078,142 which covers film-based stereotactic breast biopsy systems. This suit also seeks damages as well as an injunction.
Fischer will continue to aggressively pursue both suits.
Fischer Imaging is a pioneer and leader in stereotactic core biopsy systems. The Company developed the Fischer Mammotest(R), its film-based system, in 1990 and added digital imaging to the system in September 1992 following receipt of FDA 510-K Premarket Clearance. Trex Medical (formerly Lorad) introduced its film-based and digital systems after Fischer introduced its systems.
