These patents don't solve the SIBIA problem.

The issuance of these patents to Cadus is significant in terms of creating/protecting their market niche. However, as has been beaten into me, a patent does not give you the right to practice your invention, rather, it gives you the right to exclude others from practicing your invention. As I have come to understand the Cadus-SIBIA battle (see news clips below), SIBIA has sued Cadus for the use of the assays which the Cadus' patents (past and present) cover. The only impact on the litigation that these new patents have is if SIBIA could be interested in a cross-license to the Cadus yeast technology as means to settle the suit.

"Cadus named this its Self-Selecting Combinatorial Library Technology(SSCL), and earlier this year received a patent for the composition and method of use for the system. Not long after that, Sibia Neurosciences filed suit, claiming infringement to its own patented cell-based screening system."

"SIBIA claims its patent has been infringed upon by Cadus through its technology. Cadus uses yeast cells altered with human genes to create a cell communication pathway similar to that in human cells. The altered cells are used for testing potential drug candidates for their effect on receptors along the pathway."
