There may be others who could answer your question better than I could. Just like any lawsuit it could take months I would imagine.

My feeling is that unless the undeclared short position grows into something much larger than the 700,000 shares that has been reported, it's probably not worth it to the co. to persue. JMO That said, what Joe Murphy states would be correct, that it will take strengthening the co. to drive them out.
