On the conference call this morning, Shant Hovnanian confirmed that the First Boston financing is a floorless convertible after 90 days. His only defense is that there is an anti-shorting provision in the agreement. I don't think such a provision is enforceable. All CSFB has to do is get some no-name affiliate to do the shorting for it. Such shorting is difficult if not impossible to trace.
