Perhaps, but they also may have realized their strategic blunder. If so this move is not "tactical".

They may want to go back to the legal forum where they just got reminded by Judge Ryscamp they can and do prevail. AT least they have some litigation relief in the states where they settled. (I think ??)

Back to June settlement is still not good. Too much $$ for class-action relief.

Please!! Class actions are the least likely to hurt them. (Although most potential damage, of course.)

M& A activity will require fed approval. Never thought about it. I'll ponder that one !!
