I concur with your thoughts, although one comment you made begs the following question/comment.

You stated, "To further speculate, the disagreement may be based on a desire of the company to release info pleasing to us shareholders which the band feels may have a negative impact on the processing of the application."

It is the latter part of the above sentence that leaves a number of us (I am being presumptuous) puzzled. Namely, how exactly would a release by Sungold (presumably a positive one) negatively affect their application to the BIA.

Without further speculation, I beleive it is best to do what John has suggested, simply call the company and ask.
