One could argue that since changing technology was not a part of the theory, it should not be an accepted basis for the DOJ Law Suit.

Sure, Eugene. Who said it was? The basis is, of course, the Sherman Act. Economic theories come and go, laws are in force until repealed. Why should it matter what a bunch of academics say anyway? To repeat yesterday's post:

The Justice Department's action on Microsoft has everyone missing the point infoworld.com

Microsoft's existence depends on enforcement of intellectual property laws. Just like you and me, it has to obey the others, too -- it doesn't get to pick and choose.
