I highly doubt that Astra-Merck would ignore this filing. I am sure this startled them to say the least. That being said, if history can prove anything for the future, then Andrx will walk the legal lines quite well. Litigation is part of the business, and is expected with each filing. What is interesting though, is that I do not believe Andrx was sued for either of the last two ANDA filings prior to Prilosec, which I believe would mean clear sailing on those two.
