Sure it could! However, ChemFirst is an established player and has more resources with which to defend itself. The patent infringment suit was a sham from the start! Cabot brought the action to slow introduction of Moyco's slurry product by surrounding it with controversy. Moyco didn't have deep enough pockets to last the two plus years it would take to bring the suit to trial not to mention the lenghty appeal that Cabot would probably file when it lost. I would guess that yes, Moyco's settling the suit did help cause the run-up. Back when I first heard of NANX it was from others who were long both companies. OB
