If I recall correctly, a topic we discussed last year with regards to VoIP and cable systems dealt with the Com21 cable modem. The Com21 cable modem is compatible with 10 base T ethernet, and hence VoIP. Also, VoIP makes much better use of cable system return path bandwidth for telephony than cable telephony systems that rely on QPSK modulation of a 64 kpbs DS0.

Its a bit mind boggling how the FCC will figure out how to regulate a 10 base T ethernet bus connection to a bunch of customers with cable modems like a Com21. Between the cable headend and the end user with the cable modem, each ethernet circuit will carry a random mix of plain internet traffic (PITS), VoIP, as well as system monitoring and performance information. The VoIP traffic won't have its own discrete bandwidth. The whole idea of the cable modem like Com21 is to be able to intermix voice and data within the same bandwidth, and separate the voice traffic from the data traffic at the cable headend. It seems to me the FCC would discourage cable companies from innovation and upgrading systems to HFC and ultimately become facilities based providers of local loop voice services with premature talk of VoIP regulation.
