Does anyone know more about the law suit than what has appeared in the public filings? For example, was Madsen or any other officer named individually as a defendant? This is a common practice in these types of cases.

Was the judgment against FSCX and Madsen? If so, the plaintiff has no incentive to settle for less than the judgment amount because if FSCX can't afford to pay, certainly Madsen can.
