On the user fee question, don't think this will disappear if PPP is dissolved.
The technology still resides in the patent rights. I still don't know if you can build any type of refractive surgical laser without infringing on a BEAM or VISX patent (or both). One may end up paying two separate fees set by each company.
What's more, it should be that way. The inventors are entitled to recover their investment cost plus a profit for taking the risk. The last time I checked, the estimate was over 60 million dollars for development cost.
