From the Wall Street Journal (www.wsj.com) April 25, 1998.
A Michigan outpatient surgery center is suing VISX Inc. and SUMMIT TECH. accusing the two companies of price fixing. The suit estimates that an industry-wide total of $90 million in fees have been paid so far to Pillar point.

The newest lawsuit story hit the Dow Jones wires at 3:48 pm on Friday. That seems to be what triggered the sell off in both Visx and Beam.

"... The plaintiff, Metropolitan Eye Center and Outpatient Surgery Facility Inc. of St. Clair Shores, Michigan, is seeking treble damages for licensing fees that it paid to Pillar Point Partners, the two companies patent partnership. "

What strikes me as odd, is how the center can claim damages when the fee is paid by the consumer?

The rich get richer (doctors/LVCs) and the poor get poorer (us)...Pappy
