In Q1'98, Intel has:

Revenue of $6,001M.
Interest income of $200M.
Cost of goods of $2,119M.
General management and marketing of $711M.

Gross margin = ($6,001+$200-$2,119-$711M) / $6,001 = 56%.

You are right. The $165M is charged against R&D which is not part of the equation to compute gross margin.
