We can attribute today's Intel performance to the article in USAToday or interest rate fear, anyhow, regarding the alleged impending lawsuit......

"But one veteran antitrust litigator is not convinced a lawsuit against Intel is imminent, in part because the chip giant is in a market with competitors that provide compatible products.

"While I'd place a wager on a Microsoft suit, I wouldn't place one on Intel," said Joe Sims, with the Washington firm of Jones, Day. "These things take time, and usually you'll see a flurry of activity before it happens. I haven't seen that with Intel."

Before filing a suit, the FTC would first have to show that Intel is a monopoly, which is not as simple as showing that it has 90 percent market share, Sims said. The legal definition of monopoly requires the FTC to show that Intel could raise its prices without decreasing its market share, or that cutting its supply of chips to the market would have the effect of raising the market price for its products, Sims said.

"In other words, they would need to show there aren't any viable competitors," Sims said. "
