In my opinion (common sense rather than legal) there is no reason for the government to even be looking at the software industry much less interfering because (a) there is no key resource to control and (b) there is no gouging going on.

There is nothing MSFT owns that cannot be duplicated by it's competitors if they're smart enough and quick enough. If MSFT decided to charge $1000 for Windows, would IBM start selling more copies of OS/2? Of course they would. Would SUNW be even more motivated to invest in NCs? Of course they would. This perceived "monopoly" would vanish in less than a year. There's even a respectable freeware OS available, for crying out loud.

Basically, the DOJ arbitrarily screwed Scott Cook and friends out of $2B they rightfully earned. He thought he would be able to make electronic banking happen faster at MSFT. He was right, and consumers would have benefited from it.

Fact: There is no market sector where the cost of software increased after MSFT gained dominate market share.

Fact: MSFT's well managed competitors are growing like weeds.

Fact: The emergence of the US computer industry, led by MSFT and INTC, has been vital to maintaining the country's share of the global economy.

Fact: The DOJ knows jack about producing world class software.

Conclusion: The DOJ should help the country by procecuting software pirates, not by harassing it's most dynamic corporations. Consumers are perfectly capable of efficiently determining the winners in the Information Age, thank you very much.
