A federal judge can buy stocks, but should not buy in company's which have cases pending before them. Every federal case has the parties file a form saying if the company is publicly held, and if there are parent corps. That way the judge can recuse themselves if they own that stock.

Judge's usually move thing sup only if "irreparable" harm might occur during the delay. Here the harm can't be irreparable since the harm can be easily repaired by damages. In the end this is only a suit about money, and money damages are not irreparable.

This sort of hearing can be a short process. Some judges dispose of case within a year of filing the complaint (much less a year after the Markman briefs have been filed).
