Scott, When you buy a can of Coke, you don't usually "simultaneously" hand over your money to the cashier as they hand the can to you. Rather, they give you the product with the knowledge that in the next few moments, you will renumerate them. The same applies to the exchange of money for products downloaded over the internet, etc, as is relevant to the GIFT patent. The product is distributed with the intent that payment is to be received, and this intent occurs simultaneously - however, it is pretty unlikely that any actual payment would occur "simultaneously" with the delivery of the product. I don't see how delaying delivery of a product 5 minutes or 5 months after I ring through/ e-mail my credit card number is any different (except for the poor quality of service) as it applies to the GIFT patent. Nice play on words, you devious devil, but this advantageous interpretation of a dictionary definition is unlikely to fly. Then again, stranger things have happened in a court of law...
