Off shore accounts private investors can short any stock . Including pennies. Now there are rules to that but they can. Typically you need $2.50 for every share you short on a penny stock under $1.00. Also I believe you have to cover the same day or within three days.

Now if a financial institutions holds the shares they can short against the box. That means short it using the shares they have as collateral.
Shake out the weak ... cover and be ready to start again.
