Bernard,

You're missing Jason's point. He is not saying that WinStar should distribute dividends. He is saying that shareholders in WinStar do not have rights to the cash flow that does exist and, therefore, do not have ownership in anything of value. As Jason states:

<<It doesn't necessarily have to be distributed, but it has to BE AVAILABLE FOR DISTRIBUTION.>>
