1) By "upholding" the claims it sounds like you mean not found invalid. Did your law firm say that she will rule on validity in conjunction with the markman hearing? 2) What prior art did your lawyer consider when opining that it would be upheld? 3) Please tell us the scope they believe will be given. Specifically, what do they think point of sale means, what does authorization code mean, and are the claims limited to "predelivered information". 4) You obtained a paid opinion. Do you mean you paid for the opinion, or did you see what a lawyer wrote for a different client? 5) Was the 3% a joke, or did they really put a number on it?
