Visited Abbey & Gardys office today to pick up the complaint.(37 pages) (IT was emailed last week but I could not down load it successfully.) After my visit I understood much more about class actions and quite frankly felt much less threatened and more secure about Slups position. I found the complaint very flakey and baseless and is flakey because they DON'T KNOW ANYTHING that we don t know. ABbey Gardys complaint is based only on what they got from " 1000 share Freddy "who wouldnt know any more then the rest of us , Press releases, and public filings. Thats all. Joshua liftshitz said the SEC woud not give out any information to anyone.The complaint basically just summarises all the press releases one by one and at the end says that all the above is false and misleading.
When I asked Joshua what they know for a fact to be false and misleading the answer was . "They have not began investigating it yet." and , They are not going to waste their time until they know if they got the case. He said there could be several other suits filed within 3 months (from May 1st) and if another lawfirm has a bigger lead plaintiff then the case could be given to them. AFter 3 months all suits filed are consolidated and the strongest firm gets it. Then slup files answer and sometime after that they begin discovery.
So basically please dont run out and sign their certificate and lend support to this lawsuit too soon . Youve got right up until July 7 to fill out a simple certificate to join theirs and apparently within the 3 months to initiate any separate action with other council if you'd prefer or if you need more time to get facts and determine if you've been damaged. Hopefully the price will have recovered to over $5 within the 3 months then there will be no basis for damages for a lawsuit and it will fizzle out. I hope someone can confirm my statements with their lawyers if there is any doubt about factuality of shareholdes rights. Joshua seemed to think trading would resume on the 14th and we'll ALL know more then. Can someone try to post the Lawsuit complaint here if possible. Thanks.
