As a matter of fact, I just spoke with Rene and he corrected me. The $10,000,000 that is being advanced by the lender on Oshawa and Niagara is to enable the projects to go ahead without delay. Accordingly Rene is relying on this commitment and is contracting and ordering now with a view to starting construction on time. This also tells me that the lender believes that any outstanding issues on completing the paper work for the full loan are surmountable and therefore they have the confidence to invest now to permit construction to go ahead.

I also had a long conversation with him and Lawrence Leibowitz regarding the upcoming hearing. As for the contempt part, they are confident that Rene won't be held in contempt because Rene relied on expert advice as to what he was obligated to deliver and did so accordingly. This sounded reasonable to me. As for the possibility that they will be ordered to deliver drawings on their new technology, they feel equally confident that the court won't interpret the contract in such a way as to require them to deliver more up. Their case is being supported by many experts including their patent attorney who I believe will swear an affidavit that this is infact new technology and not simply an improvement iof the old technology.
